1. The Service

Wanasa is an AI audio studio: you write an idea or text and the Service generates an audio clip (reaction, qaseeda, shayla or music) that you can save into playlists, share, or publish to the public Xplore page.

The Service is provided as-is and we may add, change or discontinue features at any time.

2. Eligibility and accounts

You must be at least 13 years old, and if you are under the legal age of majority where you live, you must use the Service under guardian supervision.

You are responsible for the confidentiality of your credentials and for all activity under your account. You agree to provide accurate information and not to impersonate anyone.

We may suspend or close any account that breaches these Terms or Saudi law, or that endangers the Service or its users.

3. Your content and your responsibility

"Your content" means the prompts and text you write, the clips generated from them, playlist titles and descriptions, and anything you upload or publish.

You — not us — are fully responsible for your content and any legal consequence arising from it. You confirm you hold the rights or permissions needed for everything you submit.

4. Ownership of outputs and licence to us

To the extent permitted by law, you own the use of the clips you generate and may use them personally or commercially, provided you do not breach these Terms or the model providers' terms.

Note: AI-generated outputs may not attract copyright protection in some jurisdictions, and similar outputs may be produced for other users. We therefore do not guarantee exclusivity of outputs.

You grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, reformat, display, perform and distribute your content in order to operate, improve and promote the Service. Public display applies only to what you publish to Xplore; unpublished content stays private.

You may unpublish at any time and we will remove it from our surfaces within a reasonable period; copies already downloaded by others are outside our control.

5. Prohibited uses

You must not use the Service for any of the following:

• Content offending the divine, prophets or religions, or containing religious contempt or sectarian incitement.
• Content harming public order or public morals, or insulting the Kingdom of Saudi Arabia, its leadership or national symbols.
• Defamation, insult, slander, extortion, bullying or invasion of privacy — offences under the Anti-Cyber Crime Law.
• Pornographic or sexual content, or any content exploiting minors in any way.
• Incitement to violence, terrorism, hatred or discrimination, or promotion of drugs and prohibited substances.
• Cloning the voice of a real person (including celebrities and public figures) or producing deepfakes attributing statements to someone without their explicit written permission.
• Infringing third-party intellectual property, including protected lyrics, poems, melodies and trademarks.
• Fraud, deception, impersonation, or presenting AI-generated content as genuine.
• Circumventing usage limits, scraping, automation, reverse engineering, hacking or abusing Service resources.

6. Voices and likeness

All voices in Wanasa are AI-generated and do not represent real people. Any resemblance to a real person's voice is unintentional.

Using the Service to imitate a specific person's voice is prohibited. If you believe content imitates your voice, contact us and we will act.

7. Nature of generated content and disclosure

Outputs are machine-generated and may be inaccurate, inappropriate or unexpected despite our filters. We make no warranty as to accuracy or fitness for any purpose.

When you publish or share content outside the Service, you are responsible for disclosing that it is AI-generated where appropriate and for complying with applicable Saudi generated-content guidance.

8. Publishing to Xplore and moderation

Publishing to Xplore is optional and makes your content public. We may review, remove, restrict or suspend published content or accounts — with or without notice — where these Terms or the law are breached.

We are not obliged to pre-screen all content, and its presence is not an endorsement. Reporting tools are available and we handle reports within a reasonable time.

9. Intellectual property and copyright claims

The Wanasa name, logo, design and software are ours and protected by the Saudi Copyright Law and Trademarks Law. They may not be copied or used without written permission.

If you believe content on the Service infringes your rights, email wanasa@kayantech.ai with: a description of the protected work, a link to the infringing content, your contact details, and a statement that the information is accurate and that you are the rights holder or authorised agent. We review claims, remove infringing content when established, and may terminate repeat infringers.

10. Subscriptions and payments

The Service may offer free and paid tiers or in-app purchases. In-app purchases are processed by the Apple App Store or Google Play and are subject to those stores' terms and refund policies.

Subscriptions auto-renew unless cancelled before the period ends via your store account settings. Prices may change with prior notice. Fees are non-refundable except as required by law or store policy.

Fair-use limits (e.g. clips per day) may apply to keep the Service stable.

11. Availability and changes

We aim for continuous availability but do not guarantee it. The Service may pause for maintenance or reasons beyond our control (including AI provider outages).

We may amend these Terms and will update the date shown; continued use after posting constitutes acceptance.

12. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement, or that outputs will be error-free or culturally/religiously appropriate.

13. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, consequential, incidental or special damages, nor for loss of profit, reputation or data, arising from your use of the Service or generated content.

Our total aggregate liability, however caused, will not exceed the amount you paid us in the 12 months before the event, or SAR 100, whichever is greater.

14. Indemnity

You agree to indemnify, defend and hold harmless us, our staff and our providers from any claims, proceedings, fines or legal fees arising from your content, your breach of these Terms, or your violation of third-party rights or Saudi law.

15. Termination

You may terminate by deleting your account at any time. We may suspend or terminate the Service on breach. Sections on intellectual property, indemnity and liability survive termination.

16. Governing law and disputes

These Terms are governed by and construed under the laws of the Kingdom of Saudi Arabia, including the Personal Data Protection Law, the Anti-Cyber Crime Law, the Copyright Law and the E-Commerce Law.

The competent courts in Riyadh have jurisdiction over any dispute, unless the law provides otherwise. The Arabic text prevails in case of conflict with this English translation.

17. App store provisions

This agreement is between you and us only, not with Apple or Google. The store is not responsible for the app, its content, technical support, or any product or intellectual property claims.

You confirm you are not located in a country subject to a U.S. embargo and are not on any prohibited-party list. The store operator is a third-party beneficiary entitled to enforce these Terms against you.
